TERMS OF SERVICE - COCO'S CONNECTED

Welcome to Coco's Connected. By subscribing to our online coaching services, you agree to the following terms and conditions. Please read them carefully.
IMPORTANT: By completing your subscription, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
1. SERVICE DESCRIPTION
Coco's Connected provides personalized online fitness coaching services, including:
- Customized workout programs tailored to your goals and equipment
- Weekly personalized meal plans designed for your individual needs
- Weekly performance review PDFs
- Weekly personal check-ins via Instagram DM
- Monday morning motivational messages
- Direct message support and form checks
- Full access to the Trainerize app for tracking progress
2. MINIMUM COMMITMENT PERIOD
All coaching programs require a minimum 12-week commitment period. This commitment begins on the date of your first payment and continues for 12 consecutive weeks.
During this 12-week period, you are committed to the full subscription term and cannot cancel your subscription. This minimum commitment ensures you have adequate time to see results and establish sustainable habits.
3. CANCELLATION POLICY
After the initial 12-week commitment period, you may cancel your subscription at any time by providing one week's written notice before your next billing date.
To cancel, please contact us via Instagram DM or email at shannonbirch@cocospersonaltraining.com.
Cancellation requests must be received at least 7 days before your next scheduled payment to avoid being charged for the following week.
4. PAYMENT TERMS
Subscription fees are charged weekly in advance. By subscribing, you authorize Coco's Connected to charge your selected payment method on a recurring weekly basis.
All prices are in Australian Dollars (AUD) unless otherwise stated. Payment is processed securely through Stripe.
If a payment fails, we will attempt to process it again. Continued payment failures may result in suspension of services until payment is successfully processed.
5. CONTENT USAGE RIGHTS
By providing any content to Coco's Connected (including but not limited to photos, videos, testimonials, progress updates, transformation stories, or any other materials), you grant Coco's Connected full rights to use, share, and reshare such content for marketing and promotional purposes.
This includes, but is not limited to:
- Use on social media platforms (Instagram, Facebook, etc.)
- Use on the Coco's Connected website
- Use in marketing materials, advertisements, and promotional content
- Use in testimonials and case studies
You retain ownership of your content, but grant Coco's Connected a perpetual, worldwide, royalty-free license to use it for business purposes.
6. PROGRAM DELIVERY
Your customized meal plan and workout program will be delivered through the Trainerize app within 48 hours of completing your onboarding form and payment confirmation.
Weekly meal plans and program updates will be delivered as scheduled. If you experience any delays, please contact us immediately.
7. CLIENT RESPONSIBILITIES
As a client, you agree to:
- Provide accurate and complete information during onboarding
- Follow the provided meal plans and workout programs as designed
- Complete weekly check-ins and provide honest feedback
- Update your progress photos and measurements regularly
- Communicate any concerns, injuries, or changes in circumstances promptly
- Maintain respectful and professional communication
8. HEALTH AND SAFETY DISCLAIMER
Important: Before beginning any fitness or nutrition program, consult with your healthcare provider, especially if you have any medical conditions, injuries, or concerns.
Coco's Connected programs are designed for general fitness and health improvement. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
You acknowledge that participation in any fitness program involves inherent risks, and you assume full responsibility for your health and safety.
9. REFUND POLICY
Due to the digital nature of our services and the personalized nature of our programs, we do not offer refunds for completed weeks of service.
If you experience technical issues preventing access to your program, please contact us immediately and we will work to resolve the issue.
10. PROGRAM MODIFICATIONS
Coco's Connected reserves the right to modify, suspend, or discontinue any aspect of the service at any time. We will provide reasonable notice of any significant changes that affect your subscription.
Your workout programs will be updated every 6 weeks to ensure continued progress and prevent plateaus.
11. COMMUNICATION
Primary communication will occur via Instagram Direct Messages. You are responsible for maintaining access to your Instagram account and checking messages regularly.
We aim to respond to all messages within 24-48 hours during business days.
12. INTELLECTUAL PROPERTY
All workout programs, meal plans, educational content, and materials provided by Coco's Connected are protected by copyright and are for your personal use only. You may not share, distribute, or resell any program materials.
13. LIMITATION OF LIABILITY
Coco's Connected shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services.
Our total liability for any claims related to our services shall not exceed the amount you have paid in the 12 weeks preceding the claim.
14. CHANGES TO TERMS
We reserve the right to modify these Terms of Service at any time. Material changes will be communicated to active subscribers. Continued use of our services after changes constitutes acceptance of the new terms.
15. GOVERNING LAW
These Terms of Service are governed by the laws of Australia. Any disputes will be resolved in the courts of Victoria, Australia.
